Terms of Service

These Terms of Service ("Terms") constitute a binding agreement between you ("User") and PhoneOut ("we", "us", "our"), governing your access to and use of the PhoneOut voice calling service available as a Telegram Mini App. By using PhoneOut, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

1. Service Overview

PhoneOut provides browser-based Voice over IP (VoIP) calling to landline and mobile phone numbers worldwide. The service operates entirely within the Telegram platform and requires no additional software installation, SIM cards, or carrier contracts. The underlying voice infrastructure is provided by Twilio, Inc., a third-party telecommunications platform. PhoneOut acts as an interface layer; call routing, connectivity, and telephony operations are handled by Twilio's network.

2. Eligibility

You must be at least 16 years of age to use PhoneOut. By accessing the service, you represent and warrant that you meet this minimum age requirement and have the legal capacity to enter into these Terms.

3. Account and Authentication

Your PhoneOut account is linked to your Telegram user identity. You are solely responsible for maintaining the security of your Telegram account and for all activities that occur under your profile within PhoneOut.

4. Credits, Billing, and Rates

Calls are billed per minute based on the destination country at rates displayed prior to each call. Credits are purchased using Telegram Stars through the native Telegram payment interface. Full rate list for all 220+ countries is available on the Star Prices page.

• Per-minute rates vary by destination and are subject to change with reasonable notice.
• Call charges are rounded up to the nearest full minute.
• A minimum non-reducible balance of 100⭐ (Stars) is maintained on each account. Active calls are automatically disconnected when the remaining balance falls below this threshold.
• Purchased credits remain available indefinitely unless the account is terminated for violation of these Terms.
• Credits are non-transferable between users.

5. Acceptable Use

You agree to use PhoneOut exclusively for lawful purposes. The following activities are strictly prohibited:

• Automated, robotic, or mass calling operations
• Harassment, threats, or fraudulent communication
• Impersonation of any person or entity
• Use for telemarketing or unsolicited commercial calls
• Any activity that violates applicable local, national, or international law

Violation of these provisions may result in immediate account suspension and forfeiture of remaining credits without refund.

6. Call Quality and Availability

We endeavor to provide reliable, high-quality voice service. However, call quality is dependent on factors outside our control, including your internet connection speed, network congestion, and carrier routing. We do not guarantee uninterrupted or error-free service and shall not be held liable for dropped calls, latency, or degraded audio quality.

7. Emergency Services Disclaimer

PhoneOut is not a replacement for traditional telephony. The service does not support calls to emergency numbers (e.g., 911, 112, 999). You must maintain access to a separate communication method capable of reaching emergency services at all times.

8. Privacy and Data

We collect your Telegram user ID and call metadata (destination number, call duration, timestamp) solely for billing and service operation. We do not record, store, or monitor call content. We do not share personal data with third parties except as required by applicable law.

9. Refund Policy

Refund requests for unused credits may be submitted within 14 days of purchase by contacting our support bot. Credits that have been partially or fully consumed through completed calls are non-refundable. Refunds are processed in Telegram Stars to your account.

10. Limitation of Liability

The service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of PhoneOut, including but not limited to lost revenue, data loss, or missed communications.

11. Modifications

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Your continued use of PhoneOut following any changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any dispute arising out of these Terms shall be resolved through binding arbitration.
